ऑल इंडिया सेंट्रल गव्हमेंट पेन्शनर असोसिएशन नासिक शाखेचे वार्षिक अधिवेशन बुधवार दिनांक 6-3-2024 रोजी स्वामी समर्थ मंगल कार्यालय नाशिक येथे मोठ्या उत्साहात संपन्न झाले.सभेच्या अध्यक्ष स्थानी श्री अरविंद जाधव हे होते. सभेस प्रमुख पाहुणे म्हणून असोसिएशनचे जनरल सेक्रेटरी श्री एच् .एफ्. चौधरी, असिस्टंट जनरल सेक्रेटरी श्री के.एस. कुलकर्णी विभागीय रिजनल सेक्रेटरी श्री. रोहिदास हे हजर होते.पाहुण्यांचा परिचय सेक्रेटरी श्री. विनायक सूर्यवंशी यांनी सभागृहाला करून दिला.त्यानंतर पाहुण्यांचा शाल बुके देऊन सत्कार करण्यात आला.

 प्रास्ताविकात नाशिक शाखेच्या कामकाजाची माहिती श्री सूर्यवंशी यांनी सभागृहाला सांगितली. मागील सभेचे इतिवृत्त, वार्षिक अहवाल, जमाखर्च ,सेक्रेटरी श्री .विनायक सूर्यवंशी यांनी सभागृहाला वाचून दाखविला. त्याला सर्वानुमते मंजुरी देण्यात आली. प्रमुख पाहुणे श्री चौधरी साहेब यांनी अखिल भारतीय स्तरावरील विशेषतः BSNL  पेन्शनर्सच्या पेन्शन रिव्हीजन बाबत दिल्ली स्तरावर आपली असोसिएशन जे प्रयत्न करीत आहे त्याची सखोल अभ्यासपूर्ण माहिती त्यांच्या भाषणातून दिली.श्री.के.एस. कुलकर्णी यांनीही ह्या पेन्शन रिव्हिजन बाबत चालू घडामोडींचे विश्लेषण करून असोसिएशन या बाबतीत पूर्ण पणे प्रयत्नशील असल्याचे सांगितले.रिजनल सेक्रेटरी श्री. रोहिदास यांनी नाशिक शाखेच्या कामकाजा बाबत समाधान व्यक्त केले. मान्यवरांच्या हस्ते 75 वर्षं पूर्ण झालेल्या 15 सभासदांचा सन्मान पत्र देऊन सत्कार करण्यात आला.शेवटी श्री अरविंद जाधव यांनी अध्यक्षीय भाषण केले.आभार प्रदर्शन श्री चिंतामणी मुळे यांनी केले.कार्यक्रमाच्या यशस्वीतेसाठी सर्वश्री राजेश भालेराव, अजित कुलकर्णी,पी डी काळे,बी जी डहाळे,आर डी म्हस्के,आर एच वाजे,बी .एन. वाघ, सुनील रनाळकर, शशिकांत उपासनी, अन्वर शेख, बि.जे.  भोसले, एस. . देसाई व्हि.डि. देशपांडे , पी.बी.फासे, दिलीप कासार,  व्हि.डी. गवांदे, सी.डी. मुळे, आर. आर. शिंदे आर .जी सोनार, पी .एम क्षिरसागर, .के.दुगजे ,आर . एच. वाजे ,बाळासाहेब दुसाने, एम एम महाले, जे. एस .पठाण, एस के दातरंगे, सौ अनघा माचवे, सौ विजया मालपाणी श्री शुक्ल इत्यादींनी  विशेष परिश्रम घेतले.

सुग्रास भोजनाची व्यवस्था करण्यात आली होती.राष्ट्रगीत झाल्यानंतर सभेचे कामकाज संपल्याचे अध्यक्षांनी जाहीर केले.

The two days (12/10/2023 & 13/10/2023), 71st Annual General Body Meeting of AICGPA HQ Pune, is being held at Akola. The hall was full in its capacity including Office Bearers, CHQ members and delegates. . The meeting started with Shri. Sane Guruji’s prayer. Shri. G. N. Kulkarni Vice President , presided over the meeting in absence of Shri. W. S. Bhome. Shri. H. F. Choudhari, General Secretary, welcomed everyone. In delegate session all Branch secretaries took the part in deliberation  and discussed the issue pertaining to the Postal Pensioners, defense and BSNL pensioners .

The open session was addressed by Shri. K.S.Kulkarni, AGS, Shri. Manohar Patki AGS, Shri. R. J. Nimbalkar ,Org. Secretary, Shri. S. B. Sonalkar Org. Secretary and Shri. H.F. Choudhri General Secretary.

BSNL-MTNL PENSIONERS PENSION REVISION – PR. Bench CAT JUDGMENT – 20.09.2023

OAs are allowed, let us wait for the copy of the judgment. A favourable judgment will benefit all pensioners. we have to wait for final and clear judgment for directions to DOPPW, DoT & BSNL. 

They  say that the Court has allowed delinking of the pay revision and pension revision. As far as delinking of pay Revision and Pension Revision is concerned, it has already been decided by the DOT as communicated to all the 17 pensioners’ associations, including those filed the case, which participated in the meeting with the DOT on 17-10-2022 . This is nothing new. It is an already decided matter.

Pensioners Association Hq, Pune and Defence Accounts Pensioners Association:  Pune was held at O/O PCDA, Pune on 21st July-2023 under the presidentship of Hon'ble Secretary Shri V. Srinivas IAS, Min. Of Public Grievances & Pension. Shri Sanjeev Narain Mathur Addl. Secretary DOP&PW and Smt Ramanjit Kaur Sr. Consultant were present. H. F. Chaudhari General Secretary shared the main Activities of our Association and highlighted the issues faced by the Central Government Pensioners. Shri S. K. Deshpande spoke about the contributions of Late Shri Y. V. Chandrachud, Shri T. T. Krisnanachari, Shri Prahlad Gajendragadkar for the dignity of the pensioners.

PENSIONER'S OUTREACH & PENSION Adalat was held at O/O DY. CCA, Maharashtra, Regional Office Nagpur on 16th August, 2022 at 11 am.


Shri H. F. Chaudhari,  General Secretary, Shri G. G. Nerkar, Org. Secretary  Vidarbha attended the same.
In Inaugural speech Mrs  Vibha Mishra, CCA, Maharashtra  informed that through the programme of Distribution of Identity Cards to Telecom pensioners and Pension Adalat we are reaching to the BSNL/DOT pensioners spread O er in Maharashtra & Goa.
Distribution of Identity Cards is symbolic and Printed Identity Cards of  the Pensioners, who applied for I-Card will be sent to their postal Address.
About Pension Adalat they received 19 Applications. Most the grievances are related with BSNL. The grievance will be sorted out  with the coordination with GM BSNL Nagpur.
Shri H. F. Chaudhari in his address mentioned
1. Pension Adalat is very positive approach to settle the Pensioner's long pending grievances. 2. Appreciated the settlement of grievances by CCA, Maharashtra even during Lock down period by arranging Pension Adalat through VCs.
3. Repeated our demand of sending SMS  indicating the New PPO No. to the pensioners at the time of Migration from Banks to SAMPANN.
4. Informed Some SSA's are raising queries and delaying  the processing of  the applications for Fixed Medical Allowance in respect of pensioners residing in Non-CGHS area.
5  Requested to arrange Camp for Identity Cards and Pension Adalat at Pune , Aurangabad and big cities.

At the end CCA, Madum summed up the issues raised and informed that...
The pdf file displaying Old PPO No and New PPO No (in respect of Pensioners migrated from Bank of Baroda to SAMPANN) is being uploaded on their Website.
Secondly, CCA office discuss the delay is processing of Applications of FMA and take concrete decision.
She also assured to arrange Distribution of Cards and Pension Adalat at Pune, Aurangabad area.

We had meeting with Dr.(Mrs.) D. M.Desai Additional Director CGHS on 4th August 2022 at 14.30 hrs.  We discussed the need of additional CGHS Wellness Centres at Thane, Kalyan and Panvel.
She informed
1. The opening of CGHS Wellness Centre  at Thakurli near Railway station is under process.
2. Regarding Thane, getting accommodation was issue, instead there is a demand from Vikroli.
3. She said they are keen to open Wellness Centre at Panvel. Their should be a proposal from Trade Union/Association and proposed accommodation also. Shri Patki AGS to expedite the proposal.

We had meeting with Shri Abhijeet Bansode, DPS looking after the charge of  CPMG on 4th August, 2022 at 12.30 for an hour.
Shri M. M. Tikekar, VP,  H. F. Chaudhari, General Secretary, K. S. Kulkarni AGS and Manohar Patki AGS represented the Association.
We discussed all the points as per our Agenda and the grievances addressed by the Branch Secretaries.

The brief of the proceedings will be posted in due course and printed in the next Bulletin.

We met Shri Vijay Kumar General Manager Finance O/o CPMG  on 4th August 2022 at 11.45 hrs.  DIscussed in brief mainly  holding of Pension Adalat in Circle/Regional/Divisional Level.
We requested to follow the guidelines issued by DOP&PW, New Delhi
He informed the holding of Pension Adalat at Mumbai on 19th September, 2022. Notification is received through our Email_id .

Distribution of Identity Card Function was arranged by CCA, Maharashtra & Goa on 2nd August-22 at 11am.        The function was attended by our AGS shri K. S. Kulkarni. As Inaugural function CCA, Maharashtra distributed cards to few DOT/BSNL pensioners.

Exclusion of Central Government Employees from NPS 1392. Shri Javed Ali Khan: Will the Minister of Law and Justice be pleased to state:

(a) whether Department of Pension and Pensioners’ Welfare had sought comments of Department of Legal Affairs (DLA) again vide Note dated 24/03/2022, regarding issuing general orders for exclusion of central government employees from the purview of NPS and to cover them under OPS whose advertisements for recruitments were issued on or before 31/12/2003 in view of various judgments of Apex Court;

(b) if so, whether DLA has furnished its final comments in response to above in the month of May, 2022;

(c) if so, full details of comments furnished along with the date thereof; and (d) if not, reasons for delay?

ANSWER MINISTER OF LAW AND JUSTICE (SHRI KIREN RIJIJU)

(a) &(d): Yes Sir, the Department of Pension and Pensioners’ Welfare (DoP&PW) made a reference dated 24/03/2022 to the Department of Legal Affairs (DLA) seeking advice regarding the inclusion of https://www.staffnews.in central government employees under Old Pension Scheme on the basis of the date of advertisement being on or before 31/12/2003 of the posts against which they were appointed and whether it would be legally feasible for the DoP&PW to issue executive instructions in this regard. The issue was examined in the Department of Legal Affairs in the light of the comments given by the Department of Financial Services in the matter andvide note dated 06/05/2022, it was opined that the proposal of the administrative Departmentis a matter of policy of the administrative Department/Ministry. Further, the notification dated 22/12/2003 is silent about the date which would determine the applicability of NPS - the date of joining or the date of Notification/Advertisement.

Also, on the basis of judgments in various court cases, DoP&PW has allowed one-time option to opt for OPS/NPS for employees whose selection for appointment were finalized before 01/01/2004 but joined Government service on or after 01/01/2004 due to administrative lapse in their recruitment process. Therefore, an administrative decision to issue executive instructions providing for coverage of Government servants under OPS who were appointed to Central Government service on or after 01/01/2004 on the basis of advertisement/notification of vacancies issued prior to 01/01/2004 is in order.

A Government servant who is dismissed or removed from service forfeits his pension and gratuity.  However, competent authority may sanction a compassionate allowance not exceeding two - thirds of pension or gratuity or both in deserving cases. Now, the decision on compassionate allowance shall have to be taken within three months after imposing penalty of dismissal.  In cases where an order imposing penalty of dismissal or removal was issued before commencement of these rules, a decision on compassionate allowance will have to be taken within 6 months, if not already taken. (Earlier, in most cases, the concerned authorities were not taking any decision on grant of compassionate allowance after dismissal of employees. After their death, families were also not getting family pension.)

The scope of the rule has been widened to include payment of interest at GPF rates in case of delay in payment of pension,  gratuity  and family pension  on account of  administrative reasons or lapses and also for fixing of responsibility in such cases. Forms & Formats

The Forms and Formats for submission of claims and for processing of pension/family pension cases have been streamlined and rationalised to make them compatible with the rules. On death of a pensioner, the spouse is now required to apply to the Bank for commencement of family pension on Form !2, which requires only the minimum required details. Earlier, Form 14 required several unnecessary details.

As you are aware, Department of Pension & Pensioners’ Welfare has recently reviewed and rationalised the Central Civil Services (Pension) Rules, 1972 and notified the revised Central Civil Services (Pension) Rules, 2021 on 20th December, 2021. The revised Rules encompass several policy and procedural changes/improvements. The revised rules are available on our website/pensioners’ portal.

 

2. Union Health Minister Mansukh Mandaviya has reviewed the issue of outstanding CGHS dues of around Rs 1,400 crore and ordered officials to clear those within a month, official sources said.

According to officials, there are complaints of over 11 lakh bills pending for the last few months, forcing many empanelled hospitals to discontinue cashless treatment of Central Government Health Scheme (CGHS) beneficiaries.

At the three-hour-long review meeting on Monday, Mandaviya ordered the health secretary, the CGHS director and the CEO of the National Health Authority to present a detailed report on the matter and the solutions to it, a source said.

He instructed them to clear nine lakh pending CGHS bills within 15 days and repay all pending dues within a month. The health minister also ordered officials to increase the number of claim clearance officers immediately to clear the pendency, official sources said.

OFFICE MEMORANDUM

 

Subject: - Eligibility for two family pensions- clarification regarding

 

 

The undersigned is directed to state that representations/references have been received

in this Department seeking clarification in regard to entitlement of a member if family for

family pension from two different sources in respect of the same Government

servant/pensioner, e.g. in respect of military service and civil service or in respect of service

rendered in autonomous body and civil Government Department.

 

2. Before amendment of the erstwhile Central Civil Services (Pension) Rules, 1972 on

27th December, 2012, sub rule 13-A of Rule 54 of those Rules prohibited grant of family

pension from the civil side to a re-employed military pensioner, if the military pensioner had

opted for family pension for the military service rendered by him. Similarly, sub-rule 13-B of

Rule 54 of those Rule prohibited grant of two family pensions to a person who was already in receipt of Family Pension or was eligible therefor under any other rules of the Central

Government or a State Government and/or Public Sector Undertaking/Autonomous

Body/Local Fund under the Central or a State Government. Sub-rules 13-A and 13-B were

omitted vide notification No. l/33/2012-P&PW (E) dated 27th December, 2012 (effective

from 24th September, 2012). Thus the restriction on entitlement of family pension from two

different sources in respect of the same Government servant/pensioner in such cases was

removed by the aforesaid amendment notification. This position was also clarified vide this

Department’s O.M. No. l/33/2012-P&PW (E) dated 16th January, 2013.

 

3. The Central Civil Services (Pension) Rules, 2021 have been notified on 20th

December, 2021 replacing the erstwhile Central Civil Services (Pension) Rules, 1972. Rule

50 of the Central Civil Services (Pension) Rules, 2021 deals with family pension. This rule

also does not provide for any restriction on grant of family pension from two different

sources in respect of the same Government servant/pensioner.

 

4. In view of the above, it is clarified that there is no restriction in the Central Civil

Services (Pension) Rules, 2021 on grant of family pension to a family member from two

different sources in respect of the same Government servant/pensioner, in cases referred to in para 2 above.

 

5. However, entitlement of two family pensions to a member of the family consequent

on death of two different Government servants/pensioners shall continue to be subject to the restriction in sub-rule 12(a) and sub-rule 13 of Central Civil Services (Pension) Rules, 2021.

Meeting between the Secretary, Telecom and the AUAB.

A meeting between Ms.Aruna Sundararajan, Secretary, Telecom and the All Unions and Associations of BSNL(AUAB) was held on 02.11.2018.

At the outset, the representatives of the AUAB pointed out that DoT failed to take appropriate action to implement the assurances given by the Hon’ble MoS(C) in the meeting held on 24-02-2018, in view of which the AUAB has been compelled to go on agitational programme. On the 3rd Pay Revision issue, the Secretary, Telecom assured that the Cabinet Note, for getting the approval of the Cabinet, would be sent at the earliest. The AUAB pointed out that within three months the Pay Revision issue has to be settled fully, otherwise, Parliament elections would be announced, settlement of Pay Revision would become difficult. Secretary informed that some queries are there, it will be raised by DoT to BSNL in a week. As and when BSNL replies it will be processed. AUAB demanded the formalities of Cabinet memo to be completed before this month. Secretary, Telecom assured to act fast.

On the issues of allotment of 4G spectrum, Payment of Pension Contribution on the actual basic pay and Pension Revision issues, very useful discussion took place. On the 4G issue, the Cabinet Note has been sent for inter-ministerial consultation, and soon it will go for the approval of the Cabinet. On the issue of Payment of Pension Contribution on actual basic pay instead of maximum of the pay scale, the matter is being recommended for the approval of the Department of Expenditure, with a positive note of the DoT, by next week. On the Pension Revision of BSNL retirees, the Secretary Telecom appeared to be convinced with the arguments of the AUAB, that it should not be linked with the Pay Revision of the serving employees. She directed the Member (Services) to immediately discuss the issue with her. On the 30% Superannuation benefits for the Directly Recruited employees, the Secretary Telecom said that it should be settled by the BSNL. Thereafter CMD assured to examine another 2%.

After the meeting with the Secretary, Telecom, the meeting of the AUAB was held and a review was made. The meeting expressed it’s satisfaction about the discussions on the issues of Allotment of 4G spectrum, Payment of Pension Contribution and Pension Revision. Even though the approach of the Secretary, Telecom, was positive yesterday, the AUAB meeting viewed that the progress in the matter of 3rd pay revision is not satisfactory.

Hence, the meeting decided to go ahead with the agitational programme of holding rallies on 14.11.2018, and called upon the employees to effectively organise the same. It is decided that the AUAB will again meet on 14-11-2018, to review the situation.

Organisational decisions of the AUAB.

Prior to the meeting with the Secretary, Telecom, a meeting of the AUAB was held at NFTE’s office, under the chairmanship of Com. Chandeswar Singh, GS, NFTE BSNL. After finalising the strategy to be adopted in the meeting with the Secretary, Telecom, the meeting discussed about the ways and means to strengthen the unity of the AUAB and its functioning. After detailed discussion, the following decisions are taken unanimously:-

(1)Com.Chandeswar Singh, GS, NFTE BSNL, is elected as the Chairman of the AUAB.

(2)Com.P.Abhimanyu, GS, BSNLEU, is elected as the Convenor of the AUAB.

(3)Notices for struggles will go with the signatures of all the General Secretaries of the constituents.

(4)All other letters / communications to the BSNL Management/ DoT / Government, will be signed by the Chairman and the Convenor.

(5)AUAB should immediately be formed at all circles and districts, wherever it is not formed so far. As regards the posts of Chairman and Convenor, the pattern adopted at the All India level should be adopted at the circle and district levels also.

General Secretary’s Speech on Working Problems taken and pending issues on 07.10.2018

 

First of All I welcome you all for this CWC and hope we will have useful deliberations which will reinforce the belief amongst the members resulting expansion of our Association.

You have elected me as General Secretary  at 67rd ALL India Conference held on 11th November, 2017 at Pune  with one voice. I am deeply humbled by this great honour of being elected as General Secretary of  such oldest and recognized pensioners association.  

Organizational:

Talegaon Branch in its Extra- Ordinary General   Body meeting held on 17th January, 2018, resolved unanimously   to get merged  with Pimpri Chinchwad branch.  President/Secretary hold the Bi-Monthly meeting at Talegaon(Dabhade)

Dadar Mumbai Branch has been renewed  and new Executive body is elected in the Extra-ordinary General Body meeting held at GPO Mumbai, on 3rd March, 2018, We wish all the best to the new office bearers.

Leading Jalgaon Branch in Khandesh, which was disturbed since Sept, 2014 is revived in the Extra-Ordinary General Body  Meeting  held on 17th July, 2018. I am thankful to Shri G. S. Kothalkar Ex-Branch President and shri H. N. Patil,  Stalwart of our Association, who have taken our call  very positively and arranged the Special AGM.  In Vidarbha,  Amravati  Branch which was almost defunct  since 2014 is revived in the Extra-Ordinary General Body Meeting  held on 17thAugust, 2018.  Postal Pensioners Association is also merged with our association. I am thankful to Shri L. M. Parimal, welknown postal pensioner, Shri V. G. Tamhane,  Shri P. B. Sonar and Shri W. D. Mahore, who have taken our call  very positively and arranged the Special AGM, successfully electing  the new body of the Branch unanimously. Let us wish all the best to the new executive bodies of the above mentioned branches for reinforcing the belief among the members and future growth.

Smt. B. G. Wadikar, who was elected as Treasurer in the AIC held on 11th November, 2017 has resigned on 02/04/2018. Mrs. S. U. Kurtkoti looked after the day to day work of Treasurer in the absence. Shri S. M. Deshpande is willing to accept the post of Treasurer and assisting since Mid-August, 2018. As per the provision in the Constitution CWC may co-opt the willing  person in vacant post till Next AIC. I hereby propose to co-opt Shri S. M. Deshpande as Treasurer. Paper on,  how to remit the quota to Headquarter?  is placed in the folder for your guidance.

We have also addressed a letter to Shri S. Gopalan, Secretary, Coimbatore Branch, to  be associated with our association  as his active participation earlier. 

Pending: We are not getting required response from Ahmednagar and Khamgaon Branch.  I am in the contact with some pensioners in Ahmednagar and Shri Lagad, Secretary Akola branch for renewal of Khamgaon branch. I appeal the  Executive members , to contribute  for the renewal of these branches.

Implementation of  Revision of Pension as per 7th CPC:

  As BSNL units were  not responding positive for fixation of notional pay as on 01.01.2016 as per DOP&PW order dated 12th May, 2017,  I met on 11th August, 2017 to DDG Accounts/Advisor (Finance), DOT and demanded that CCA may initiate the revision of pension/family pension on the basis of the records available, without waiting for the information from BSNL units. While addressing the Open Session of our All India Conference on 11th November, 2017, Shri P. K. Sinha, Advisor(Finance) declared that the work of revision of pension(7CPC) has been undertaken and would be completed by December, 2017. Barring few DOT pensioners, whose files were not traceable, all DOT pensioners received the revised orders by March, 2018. We have made the correspondence in respect of left out   cases with CCA, and also ensured the settlement of last leg of cases in  National Pension Adalat held at Pune on 18/09/2018.

First National Pension Adalat for VSNL & MTNL pensioners  was also held on 18/09/2018 by CCA Mumbai at Mumbai resulting settlement of 27 cases out of 35 received grievances.

The meeting  with Shri S. K. Pande, Director of Accounts(Postal) held  on 13th August, 2018  was successful in solving the ground level issues in revision of pension as per 6th CPC delinking qualifying service of 33 years; revision of pension as per 7th CPC/non receipt of copies of revised PPO by pensioners. Out of 35500(Approx) total cases due for revision, 32500 cases have been completed.  He also instructed to the concerned officer to forward the  orders to concerned HOs in respect of DOT/BSNL pensioners issued by CCA , within one week. With the source of Shri Amashi, DAP Karnataka Circle, has also completed the revision of pension in respect of almost (15600 cases total cases).

We have taken up the following issues with CPMG Maharashtra vide Correspondence   Dt. 24th September, 2018, Adalats are not held as per guidelines, Quarterly Informal  meetings at regional and divisional  level are not granted to our Branch secretaries by most of the PMGs/SSPs, abnormal delay in endorsing/forwarding  the IDA order received from CCA, Mumbai resulting delay in payment by the HPOs.

The revision of pension of pre-2016 IITM pensioners had been approved by the administration and revised pension is  effected in May, 2018.

The  Revision of pension   for  retired employees of KendriyaVidyalayaSangathan , is ordered vide No. F.110230-3/2017-KVS (Admn-I)/ VolII Date: 14.06.2018. Branch Secretaries are requested to inform the good news to the concerned members.

Pending: We have received the complaints during AGM at Mulund on 2nd October, 2018 from retired employees of BARC that they have not received the revised PPO as yet. We have to look into.

AIC held on 11th Nov, 2017, resolved to extend the benefit of fixation of pension to all Pre-2006 pensioners based on the up gradated pay Scales. CAT Banglore and High Court Karnataka allowed the grade pay of Rs. 4600 for S-12 post. DOT has implemented the order in respect of petitioners only. The item was discussed in SCOVA held on 23.03.2018.. DOP&PW is perusing the issue for implementation for all. With the support of recent Supreme court/High Court  judgments ,  Pre-2006 retirees are entitled to the benefit of upgraded scales we are looking for the settlement of these cases soon.

Anomaly in fixation of pay of DOT employees, absorbed in BSNL and retired from 01st October, 2000 to 31st July, 2001. Hearing in Delhi High Court against the order of CAT is scheduled on 17th October, 2018.

MACP: POINT. 1. As per the provisions in the  Directorate OM No. A-7( MACP) 2009 PCC Dated 18-09-2009  the promotions earned  in the posts carrying  same grade pay  in the promotional  hierarchy as per the rules shall be counted for the purpose of MACP promotions . As such the promotions earned by the officials   on passing the competitive examinations were counted towards he promotions under  MACP ( 10/20/30). The officials were thus denied of the newly introduced  promotion under MACP after 10/20/30 years of service. We have taken up with Secretary, Department of Posts, New Delhi on 09/05/2018.

Important point: As the issue of 3 MACPs after their promotion to another cadre through competitive examinations is still not sorted out. We are anticipating relevant order from Supreme court. Time being the  promotees have to content with the existing reality.

MACP: POINT. 2. While pay of Central Govt.  Employees was revised w.e.f  01.01.2006 , the  Modified ACP Scheme  approved by Govt.  of  India, on the recommendation of Sixth CPC  was implemented prospectively  from 01.09.2008 from when revised allowances were given effect. This immediately removed a section of employees who retired in between 1.1.2006 and 31.08.2008.

In view of the Judgment of Supreme court  in case of Balbir Singh Turn & Another, (Civil Appeal  No 3744 OF 2016) Defence employees have been given the benefit  of MACP from 01.01.2006. On the basis, we have addressed on  5th Jun, 2018, the issue to Secretary, DOP, for consideration of up gradation under MACP wef 01.01.2006 instead 01.09.2008

We have to take up the case with the Secretary, Ministry of Personnel, P&G and Pensions to advance the date of implementation of MACP from 01.01.2006.  

Postal Directorate vide Memo No. 2-1/2007-PCC dated 23/05/2018 the orders to grant notional monetary benefit to the Postmen/Mail Guards w.e.f. 01.01.1996 to 10.10.1997 in the revised Pay Scale Rs. 3050-4590. The Postmen/Mail Guards who were on duty between  01.01.1996 to 10.10.1997 will get the Pay fixation benefit and consequential increase in the quantum of pension. The application to be made by such pensioner is placed in the folder.

Medical Allowance: We are aware about the inordinate delay in payment of Medical Bills and Medical Allowance in respect of BSNL pensioners. We have addressed the issue vide letter dated 6th December, 2017 to Shri Peeyush khare, CGM, Maharashtra Telecom Circle.  As per feedback of some pensioners, Medical allowance has been credited to their Bank Accounts on 21st December.

Medical allowance is continued for the year 2018-19 also, with minimum of Rs. 12000/- per year. As we received,  lot of complaints of non receipt of Medical Bills/medical allowance,  we have addressed  the grievance to shri Piyush Khare, CGM on 07th September, 2018,

It is heard that In view of the Fund crisis in BSNL, Medical Bills of Retired employees have been kept pending since 1st July, 2018 and of Working employees have been  kept pending since 1st August,2018. The payment of Medical allowance   likely  to be delayed.

3rd PRC: We have taken up the case with Member(Services)/Member(Finance), Secretary, DOT for simultaneous pension revision of BSNL pensioners along with BSNL employees based upon  implementation of 3rd PRC,  to avoid the delay in implementation of the revision of pension experienced in the past.

During the Meeting with all Unions/associations of BSNL , held  on 24th march, 2018,   Hon’ble Minister of State for Communications Shri Manoj Sinha has assured that the issue of 3rd  Pay revision for BSNL employees would be processed for approval of DPE and the Cabinet.  He also assured that needful action would be taken to settle the issue of pension revision of  the  existing pensioners.

With reference to DOT’s instructions  Dated 27.04.2018,         BSNL Corporate office vide F. No. BSNL/38-1/SR/2016 dated 28.06.2018 constituted a Joint Wage Revision Committee comprising of Five members from Official side and Five Staff side members  to recommend wage structure for Non-executive employees  w.e.f 01.01.2017.

The 3rd Meeting of Joint Wage Revision Committee  was held on 27/08/2018 under the president ship of Shri H. C. Pant.  Management  side proposed the multiplication factor of 2.4 to arrive at the  minimum of new scale. Staff side demanded the multiplication factor of 2.44. The management side agreed to examine. During the meeting  held on 14/09/2018, the staff side  accepted the pay  scales proposed by management.  We hope the Report will be forwarded to DOT soon for further processing/submission of cabinet note for approval by the cabinet.

MTNL employees had been allowed the revision of pay considering the 78.2% IDA instead of 66.8% with effect from 08th December, 2016. MTNL Pensioners Welfare  association is fighting for revision of pension considering the 78.2% IDA. In the meantime DOT considered only  73.8% IDA and issued the orders for revision. Issue is taken up with Minister to consider 78.2%.

You are aware that CCA, Maharashtra Circle has addressed a letter to us only for wide publicity and  collection of the prescribed  forms for PDA  from all DOT/BSNL pensioners. This was an opportunity to reach all the pensioners for enrollment.  I am happy to inform you that Some Branch Secretaries have done a very good job in reaching the pensioners and collecting the good number of forms, registering non-members as members of association. Branch Secretaries/Org. Secretaries , who could not do enough, are requested for  reaching the remaining DOT/BSNL pensioners and  get filled  specified form (printed in July, 2018) Bulletin and forward the same to concerned CCA Office.

We are aware that CCA has to provide facility for submission of   Annual Life Certificates at places suitable to pensioners, in the month of November each year and issue of 16A, once they take over the functions of PDA. To submit the online Life Certificate is not streamlined as yet. We have already taken up with CCA, vide letter  dated 3rd August, 2018,

Nomination for Life Time Arrears: After the death of pensioner his bank Account automatically stands closed. The arrears if any that may be payable cannot be credited to his account. The amount can be paid to a person nominated by the deceased pensioner under the payment of arrears of pension(Nomination) Rules , 1983. The nomination form is kept in the folder.

CGHS:  Advisory committee meeting was held at Pune on 25/06/2018, Pune local issues have been discussed and sorted out. Guidelines for settlement of medical claims of pensioners for treatment in Private Hospitals,  issued by Ministry of Health & Family Welfare (Bulletin –July, 2018) have also been discussed.

Additional Empanelled Hospitals  are required at Mulund/Thane/Dombivli. Shri Vardekar, Asstt. Secretary , Thane  Branch participated in the agitation programme. MPWA has also taken up the issue. It is also observed that the prescribed rates for treatment fixed for empanelled hospitals in Mumbai are lower than the prescribed rates for treatment fixed for empanelled hospitals in other Cities say New Delhi.

BULLETIN: The “PENSIONERS PROGRESS BULLETIN” published in English, Marathi was not registered with RNI as required. As per the guidelines, we required to print “PENSIONERS PROGRESS BULLETIN” in English and Marathi separately in  April, 2018  and July,2018.

Now, RNI, New Delhi cleared  the Title verification for publication in Bilingual, English and Marathi and we published  “PENSIONERS PROGRESS BULLETIN” October, 2018- December, 2018 issue in  English and Marathi. We may receive the RNI Certificate by the end of December, 2018.

  As per the guidelines received from DOP&PW, New Delhi “Swachhata Hi Seva” 2018 again from 15th September to 2nd October, 2018 is to be observed by sensitizing  our members and general public reinforcing the belief that “ Sanitation is everyone’s business’. I am thankful to Office bearers of Hq, Members of Pune , Akola, Dombivli, Nandurbar, Nashik branches for participation.

Remember, Our diversity is our strength and Our strength lies also in our unity. Terms of Reference (ToR) for the 7th CPC with the representatives of the Staff Side of JCM

 This information was received by Shri Madhav Bamne, Technical Adviser, AICGPA  through email on 22 November 2013.
A meeting was held on 24.10.2013 at 3.00 PM in Committee Room No 190, North Block under the chairmanship of Dr S.K.Sarkar, Secretary DOP&T to discuss the possible Terms of Reference (ToR) for the 7th Central Pay Commission. Shri Umraomal Purohit, Secretary, Staff Side pointed out that the new concept of Pay Bands and Grade Pay structure has (as per the 6th CPC) had resulted in a new experience which was mixed. However, 6th CPC did not recommend merger of DA with Pay. He also raised the question of Interim Relief pending finalisation of 7th CPC recommendations. He further mentioned that anomalies of 6th CPC should be resolved on priority before 7th CPC and suggested that there must be some machinery which should resolve anomalies within one year of implementation of CPC report. Shri Raghavaiah suggested that the Finance Ministry should look into the aspect of Pay Band-Grade Pay Structure vis a vis anomalies cropped up and how these can be avoided in future. He referred to anomalies relating to MACP scheme vis a vis ACP scheme and pending resolution.
Other representatives from staff side raised following issues:-
1.      Entry level pay to promotee employees at par with that admissible to Direct Recruits as was agreed in the National Anomaly Committee;
2.      One of the ToR should be to set up a special bilateral mechanism to sort out anomalies arising out of Pay Commission recommendations;
3.      Professional approach should be adopted in dealing with peculiarities concerning Railways and Defence civilian employees;
4.      There should be parity between pre & Post CPC retirees for the purpose of pension etc.;
5.      Cadre review/restructuring proposals should be delinked from the 7th CPC so that these are not delayed;
6.      Wage Revision should be effective after every 5 years as in the case of PSUs;
7.      If there is going to be separate CPC for the Armed Forces as had been reported in media, or if there is a representative of Armed Forces in the 7th CPC then there should be a representative of Labour in the  CPC;
8.      CPC should not go by “Central Secretariat” structure to make its recommendations which does not take into account specific complexities in large Government organisations like Railways, Postal Department and Defence establishments.
9.      Allowances should be enhanced concurrently with the pay consequent upon Pay commission implementation.
10. Supreme Court has upheld that MACP should be in the hierarchy of the Post and also for grant of NDA in 7th CPC rates w.e.f. 1/4/2007. These judgments should be implemented to all similarly placed employees.
11. The Secretary Staff side in the end requested that a copy of Terms of Reference as proposed by the Ministry of Finance may be circulated and then another meeting with Secretary, Department of Expenditure and Department of Personnel & Training be arranged to discuss & finalise the Terms of Reference of 7th CPC.
Draft Terms Of Reference 7th CPC by JCM New Delhi
1.      To work out the comprehensive revised pay packet for the categories of Central Government Employees mentioned (A) above as on 1.1.2014.
2.      The Commission will determine the pay structure, benefits facilities, retirement benefits etc. taking into account the need to provide minimum wage with reference to the recommendation of the 15th Indian Labour Conference (1957) and the subsequent judicial pronouncement of the honorable Supreme Court there-on, as on 1.1.2014.
3.      To determine the Interim Relief needed to be sanctioned immediately to the Central Government employees and Pensioners mentioned in (A) above;
4.      To determine the percentage of Dearness allowance/Dearness Relief immediately to be mergedwith Pay andpension
5.      To settle the anomalies raised in various fora of JCM.
6.      To work out the improvements needed to the existing retirement benefits, like pension; death cum retirement gratuity, family pension and other terminal or recurring benefits maintaining parity amongst past, present and future pensioners and family pensioners including those who entered service on or after 1.1.2004.
7.      To recommend methods for providing cashless/hassle-free Medicare facilities to the employees and Pensioners including Postal pensioners.

Information on Paperless Office & VIIth CPC
 
Dear Brothers,
 
All of us are aware about environmental protection. Paper needs cutting of trees. Hence, use of paper must be reduced to preferably zero. Our association should not lag behind as we are part of Indian citizens. In order to achieve this following action is suggested.
 
1.            All branches shall obtain email address on line of address of CHQ i.e. branch name
.aicgpa@gmail.com for Pune branch it shall be pune.aicgpa@gmail.com .
2.            Branches shall contact CHQ using addresses given earlier.
 
3.            Whenever, email is sent to a branch (es) message on mobile phone would be sent so branches can check email.
 
4.            Branches shall register members of association from their respective branch on website. Registration basically needs primary information like full name, address and contact number. Detailed information is not compulsory. In case a member wishes to add detailed information that shall be confidential and can be seen only by those who have password. After registration Name and number be intimated to CHQ. CHQ shall send the password. On receipt of password first action would be change of password and then registering your information. Priority of registration shall be as under:-
a)           President, Secretary and Treasurer.
b)           All Branch working Committee members.
c)            PP Bulletin Subscribers.
d)           All other members.
 
Registration of members shall be completed at the earliest. 4 (a) & (b) should be completed within 4 weeks from receipt of this letter, 4 (c) by 15 December 2013 and 4 (d) by end of the financial year. Branches shall find solution for their problems on their own. Advice if needed may be obtained on telephone.
 
5.            Those who want to place their respective photo they can do so after receipt of password. There is an e-locker facility available to those who are registered on website and received password. Up to 5 scanned documents can be placed in e-locker. These documents may be related to any subject meaning not necessarily related to pension.
 
6.            There are many more facilities on the website. Each and every member of the association can take advantage of all facilities. Those who register on website get additional advantage. It is suggested that more and more members should be encouraged to get email ID. There may be uniformity in email ID like Name of

 member, branch name @gmail.com .More information shall be sent on receipt of email from branches and members.

 Another important point is VIIth Central Pay commission (CPC). There is a useful article on suggested recommendations of CPC. It is available here.
http://janahitwadi.blogspot.in/2013/04/central-pay-commission-for-government.html It is recommended that every pensioner should go through it and suggest additions and deductions so that association’s recommendations could be finalised. In brief the article gives following:-
 
a.      Author has carried out mathematical analysis of the pay band, grade pay and increment rate. It gives 4 pay scales for four groups of government employees. This means there could be only 4 pay scales for entire categories of the government employees.
 
b.      From lowest of Basic pay to highest of basic pay in every pay scale there are 50 steps. All steps are clubbed in groups of 5.
 
c.      CPC would give ranks or stages and every department should give designation and starting pay for a particular post. This means every 1 in the ay scale shall not start at the lowest but at a predetermined level.
 
d.      Increment is based on the lowest basic pay in the block of 5 years. For Group D it is 3%, Group C 2.25%, for Group B 1.65% and for Group A 1%.
 
e.      For promotion suggested rules are when a person reaches the highest level in the block or earlier DPC should be held for selection of an employee for promotion. Every employee shall get 3 chances for promotion. If the employee is not found suitable by all 3 DPCs then a board shall be held to decide on efficiency test. As and when an employee clears this test he/she shall be placed in the higher block but shall hold the same post. This means pay of employee would be protected to some effect.
 
f.        Pension shall be based on the last basic pay drawn or on average of last 10 months pay as existing presently. For those pensioners who retired before date of implementation of the recommendations of the CPC shall undergo notional pay fixation for working out basic pension and family pension.
 
g.      Our recommendations shall be discussed in forthcoming GBM in December 2013 and finalised. All branches and pensioners are requested to study this and bring out changes needed.

How to find out, how many LPG cylinders you have consumed till date in FY 2012-13 ?

a) Visit petroleum Ministry’s web site http://petroleum.nic.in/

b) You can see a small hotlink on its right side top panel, where the words “LPG Portal” keeps blinking.

c) Click on “LPG Portal” and it will open to a page that gives interactive cloud-blurbs like “Rate a Distributor”, “find multiple connections in the same name” etc., etc.,

d) In this screen, on the right side bottom portion, you can see logos that are linked to your own LPG supplier – Indane, Bharatgas and HP Gas.

e) This will lead you to “Transparency Portal” where you are required to give inputs like State, City and Distributor name details.

f) After clicking “Proceed” button, you can see next screen where you have to give your consumer number / your name for search.

g) Here, you can find out the No. of LPG cylinders issued under your consumer number in Financial Year 2012-2013.

As you are aware, you are eligible for 6 cylinders (now 9 cylinders) at concessional rate and any additional cylinder will be very costly. Plan your consumption to save a few hundred rupees.

The undersigned is directed to say that in pursuance of Government's decision on the recommendations of Sixth Central Pay Commission, orders were issued for revision of pension/family pensioners vide this Department's OM No.38/37/08- P&PW(A) dated 1.9.2008, as amended from time to time.
2. It has been decided that the pension of pre-2006 pensioners as revised w.e.f. 1.1.2006 in terms of para 4.1 or para 4.2 of the aforesaid OM dated 1.9.2008, as amended from time to time, would be further stepped up to 50% of the sum of minimum of pay in the pay band and the grade pay corresponding to the pre-revised pay scale from which the pensioner had retired, as arrived at with reference to the fitment tables annexed to the Ministry of Finance, Department of Expenditure OM No.l/l/2008-IC dated 30th August, 2008. In the case of HAG and above scales, this will be 50% of the minimum of the pay in the revised pay scale arrived at with reference to the fitment tables annexed to the above-referred OM dated 30.8.2008 of Ministry of Finance, Department of Expenditure.
3. The normal family pension in respect of pre-2006 pensioners/family pensioners as revised w.e.f. 1.1.2006 in terms of para 4.1 or para 4.2 of the aforesaid OM dated 1.9.2008 would also be further stepped up to 30% of the sum of minimum of pay in the pay band and the grade pay corresponding to the pre-revised pay scale in which the Government servant had retired, as arrived at with reference to the fitment tables annexed to the Ministry of Finance, Department of Expenditure OM No.l/l/2008-IC dated 30th August, 2008. In the case of HAG and above scales, this will be 30% of the minimum of the pay in the revised pay scale arrived at with reference to the fitment tables annexed to the above OM dated 30.8.2008 of Ministry of Finance (Department of ~xpenditure).

Good News

Principal Bench CAT, New Delhi: Judgement for Interpretation of Minimum of Pay Band while Fixing Pension for Pre-2006 Pensioners.

Government of India, M of P & PW issued memorandum illustrating method of Pension fixation vide 38/37/08-P&PW(A).Pt.I. dated 3.10.2008 and 14.10. 2008. In this clarification a lower level official interpreted government resolution accepting recommendations of the VIth Pay Commission to the effect lowest of Pay in the Pay Band to Lowest of the Pay Band. As regards serving employees on 1 Jan 2006 got their pay fixed as per the new pay scales in the pay bands considering increments they had earned in the pre-2006 pay scale. Government resolution restricted the Pay for the purpose of fixation of pension to lowest of the pay in the pay band and not lowest of the pay band. Principal Bench of CAT has accepted this and issued judgement which will favour all those pensioners whose minimum of pay in his/her pay scale was higher than the minimum of pay band. Extract of the relevant portion of the judgement is as under:-
Respondents (i.e. Government of India M of P& PW) are directed to refix the pension of all pre-2006 retirees wef 1.1.2006 based on resolution dated 29.08.2008 and pay arrears thereof  within a period of 3 months from the date of receipt of a copy of this order.
CAT had criticised lower functionary in DOP & PW and also placed on records that there is no application of mind even at the level of Director and Secretary. CAT further noted that Director and Secretary merely signed the note after obtaining finance concurrence and approval of MOS (PP) without going back to the Cabinet for modification.
After receipt of copy of the judgement by G of I, M of P & PW is expected to issue orders for estimating revised pension and payment including arrears. Pensioners have to wait for government orders for receipt of payment. It should be noted that the CAT has laid down time frame of 3 months. All pensioners are advice to bring this to the notice of the local Pension Disbursement Agency (PDA) i.e. Bank or Post Office from where pension is received and obtain their view. This should be submitted in writing to the Branch of the Association for further action.
In due course of time a calculator shall be placed on website for calculating estimating revise pension and arrears. All members are advised to make full use of the calculator and ensure that they receive right payment.

2.     Government of India is offering Tablet PC to students at Rs. Less than Rs. 1400.00. All pensioners should avail this opportunity for students (School and College) in their family.

3.     Now it is easy for BSNL pensioners to make use of association’s website frequently and other pensioners as much as possible.

Association’s website allows you to find your friends and colleagues and make it easy to contact them on telephone, mobile and email etc. The only requirement is to register on the website. Members shall register free. Non-Members can register free but can use website only after payment of membership fee which is now Rs. 200.00 for life time. All members should use this facility and encourage non-members to get membership. Following gives in brief the facilities available and how to use those. If one knows branch of the member under search the number of results would be smaller. Information is available only for members who have registered on website.

1.            Search by name. It is not necessary to remember full name. Even part name is accepted by the website. However, it may give many results and then you need to find exact name from the results.

2.            Even department or designation can be used for search.

3.            If month of birth is known or date of birth is known the same can be used for search.

4.            List of Departed members and members within selected Age Range is readily created.

5.            PP Bulletin subscription can be managed by CHQ and confirmed by members. Search results show this on website.

6.            Members who register must inform CHQ preferably through email (reply paid post card also accepted) about there name and registration number displayed after successful registration. CHQ shall send members individual password. This password is used for editing/updating member’s information by the member or his/her authorised person. Password can be modified/changed by the member any time and any number of times. This is advisable to ensure better security of your account. Using password you can update all information including uploading of important documents in e-form in e-locker. Pensioners can avail this facility 24/7 hours. Heirs of pensioners can get documents from CHQ.

7.            Demise of a pensioner should preferably intimate to branch of the pensioner by member of the association on telephone and then confirmed in writing. Branch should inform every month such cases in writing giving name, registration number and date of demise. This will help in updating the website. The names of such pensioners shall be published in PP Bulletin based on the record on the website.

 The association's official website aicgpa.org was launched on 14th Nov 2007 and was inaugurated by Late Shri Bhalchandra Deshmukh, Ex Honorary Adviser to AICGPA on 13th December 2007. The website was developed by Shri Madhav Bamne, Technical Adviser and was designed and programmed by Shri Sachin Dhake, Website Programmer. The website offers many facilities useful for every pensioner and the office bearers of the association.It contents information on every need, calculators, Storage of important documents and storage of events with photos.The basic information is member's data. There is a locker available ob website for storing important documents like PPO and "Will" in electronic format. Members are not required to pay for this facility. The only requirement is the member should be registered on the website. This is needed to ensure security and to keep it confidential. These can be accessed by the members and his representatives only. Information is available to his/her legal hair only when the member leaves this world. CHQ is of the opinion that we must adapt to changes as had been done in past. Initially all information and letters were hand written. Typewriter was introduced and we started using it. Then cyclostyle machine came in vogue. The only method of communication had been letters and talk in person. We changed to telephonic talk. Landline phones were in vogue. Now mobile phones are extensively used. Tele-conferencing has become normal. We had changed from time to time. Hence, we should keep this spirit and start using electronic way of storing and accessing information. Usually there is misunderstanding that a computer and internet is needed to adapt to electronic method of storing and accessing information. We must remember that persons who didn't know reading and writing were using post offices to send and receive letters. Therefore, computers cannot be treated as and obstacle or excuse.What is necessary is to change ourselves and get adapted to latest technology available.Start can be done by registering each and every member on website and communicating with each other and CHQ through email.It was stressed during last CWC meeting that every branch should have a free email Id available on gmail. 5.            Those who want to place their respective photo they can do so after receipt of password. There is an e-locker facility available to those who are registered on website and received password. Up to 5 scanned documents can be placed in e-locker. These documents may be related to any subject meaning not necessarily related to pension.
 
6.            There are many more facilities on the website. Each and every member of the association can take advantage of all facilities. Those who register on website get additional advantage. It is suggested that more and more members should be encouraged to get email ID. There may be uniformity in email ID like Name of

member, branch name @gmail.com .More information shall be sent on receipt of email from branches and members.
 
Another important point is VIIth Central Pay commission (CPC). There is a useful article on

http://janahitwadi.blogspot.in/2013/04/central-pay-commission-for-government.html It is recommended that every pensioner should go through it and suggest additions and deductions so that association’s recommendations could be finalised. In brief the article gives following:-
 
a.      Author has carried out mathematical analysis of the pay band, grade pay and increment rate. It gives 4 pay scales for four groups of government employees. This means there could be only 4 pay scales for entire categories of the government employees.
 
b.      From lowest of Basic pay to highest of basic pay in every pay scale there are 50 steps. All steps are clubbed in groups of 5.
 
c.      CPC would give ranks or stages and every department should give designation and starting pay for a particular post. This means every 1 in the ay scale shall not start at the lowest but at a predetermined level.
 
d.      Increment is based on the lowest basic pay in the block of 5 years. For Group D it is 3%, Group C 2.25%, for Group B 1.65% and for Group A 1%.
 
e.      For promotion suggested rules are when a person reaches the highest level in the block or earlier DPC should be held for selection of an employee for promotion. Every employee shall get 3 chances for promotion. If the employee is not found suitable by all 3 DPCs then a board shall be held to decide on efficiency test. As and when an employee clears this test he/she shall be placed in the higher block but shall hold the same post. This means pay of employee would be protected to some effect.
 
f.        Pension shall be based on the last basic pay drawn or on average of last 10 months pay as existing presently. For those pensioners who retired before date of implementation of the recommendations of the CPC shall undergo notional pay fixation for working out basic pension and family pension.
 
g.      Our recommendations shall be discussed in forthcoming GBM in December 2013 and finalised. All branches and pensioners are requested to study this and bring out changes needed.
